1. AGREEMENT. These rules govern the "North Pole Contest," hereafter referred to as contest, run by Quark Expeditions and their marketing partners. No purchase is necessary to enter this contest. The act of entering the contest constitutes acceptance of the contest rules as contained herein and of the decisions of the contest judge.

2. ELIGIBILITY. The Contest is open to all those who have attained the age of 19 at time of entry, except for employees, immediate families and anyone living with any employee of Quark Expeditions, its corporate affiliates, and Travel Agent partners or, if applicable, any co-sponsor, their advertising or promotional agencies or affiliates. You must enter online at www.quarkexpeditions.com/north-pole-contest. Limit of one entry per valid e-mail address per person. Entry is void where prohibited by local law.

3. CONTEST. The Contest start date is June 13, 2008 at 12:01 EDT. The Contest end date is noon EDT March 13, 2009. A selected entrant will be chosen by random draw from all correct entries received. The draw will take place March 16, 2009. The selected entrant will be contacted by email by a representative of Quark Expeditions. The contestant must reply within 10 days of notification to maintain eligibility. Once notified, if the selected entrant does not claim the prize within 5 days of notification, the next eligible entry selected by random draw will be contacted, and the first entrant selected will have no further claim to the prize. To be declared a winner, the selected contestant must answer a skill-testing question. The contest is null and void should there be no prize winner after a maximum of three eligible contestants have been presented with an opportunity to claim the prize.

4. PRIZE. The contest Prize consists of an expedition for two to the North Pole, July 9 to July 24, 2009. (Retail value of the Prize is US$45,380.00.) The Prize includes:

  • Shipboard accommodation with daily housekeeping.
  • All breakfasts, lunches and dinners on board throughout your voyage. (Please inform us of any dietary requirements as far in advance as possible. Unfortunately, the ships’ galleys cannot prepare kosher meals.)
  • All shore landings and excursions per the daily program.
  • Leadership throughout the voyage by our experienced Expedition Leader, including shore landings and other activities.
  • Formal and informal presentations by our Expedition Team and guest speakers as scheduled.
  • Photographic Album on DVD.
  • A pair of waterproof expedition boots on loan for shore landings.
  • Hair dryer in every cabin.
  • A Quark Expeditions parka.
  • Coffee, tea, cocoa and bottled water available around the clock.
  • Comprehensive pre-departure materials, including a map and an informative Arctic Reader.
  • All miscellaneous service taxes and port charges throughout the program.
  • Emergency Evacuation Insurance for all passengers to a maximum of $100,000 per person.
  • One night pre- and one night post-expedition hotel accommodation with breakfast in Helsinki, Finland, based on twin occupancy.
  • Return charter air transportation between Helsinki and Murmansk.
  • All helicopter transfers and aerial sightseeing according to each day’s program.
  • Group transfers from the Helsinki hotel to the airport and from Murmansk airport to the ship for embarkation.
  • Group transfers from the ship to Murmansk airport upon disembarkation and from Helsinki airport to the Helsinki hotel at the end of the voyage – plus all baggage handling aboard ship.

The Prize has no cash value. No substitutions can be made. The Prize cannot be transferred. The Prize confirmation documents will be delivered by courier service.

PRIZE SPECIFICALLY DOES NOT INCLUDE. Return air transportation from the Prize winner's home community to Helsinki; customary gratuities for the crew, and Expedition and Hospitality Team members; required visas; incidental personal expenses; items of a personal nature; ship-to-shore communication costs; transfer from Helsinki airport to the hotel on arrival or from the hotel to the airport on departure from Helsinki; any departure or arrival taxes levied; any domestic taxes levied in the winner's country of residence as a result of winning the Prize. (Should a US resident become the Prize winner, Quark Expeditions will issue a federal 1099 form, which will be sent to the Prize winner. Any US winner must complete and submit a W-9 form (Request for Taxpayer Identification Number and Certification)to Quark Expeditions.)

5. RELEASE. To be declared a winner, the selected contestant will be required to sign an affidavit of eligibility and release form, releasing Quark and any sponsors of all liability, confirming compliance with the contest rules, and consenting to the use of his or her name and photograph, without compensation, in any publicity carried out by the sponsors and/or advertising and promotional agencies.

6. PRIVACY. We use your personal contact information to administer contests, including contacting, announcing and promoting prizewinners. In addition, we may use this information to send you information on our company and voyages ("Marketing Offers"). 7. OTHER. Contests are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. The prize must be accepted as awarded and is not convertible to cash. The sponsors reserve the right to substitute any prize or portion of the prize with a prize of equal or greater value. All prizes are awarded as-is and no warranties or guarantees are implied or expressed, beyond those outlined in the Quark Expeditions' description of the voyage. The odds of winning depend on how many eligible entries are received. Sponsors are not liable for any errors, damage or negligence that may arise in connection with this contest, including technical failures on the part of contest software, website down-time, human error or property damage incurred by any contest entrant.
